These Website Terms and Conditions ("Terms") govern access to and use of the RK Media Consulting Group website and related public forms, pages, information, and resources (collectively, the "Website"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms govern Website use only. Paid consulting engagements are governed by the final written proposal, Client Service Agreement, applicable exhibits, invoice, confidentiality agreement, data-access authorization, and any signed addendum. When a signed client agreement conflicts with these Terms regarding paid services, the signed client agreement controls.
1. About RK Media
RK Media Consulting Group LLC provides digital-media consulting, ministry-development strategy, digital-presence audits, audience and message guidance, content strategy, brand-tone guidance, social-media and platform recommendations, guided implementation, training, advertising guidance, SEO guidance, media planning, and the Ministry Momentum Transformation System™ (MMTS™), together with other services expressly agreed in writing.
2. Eligibility and Authority
The Website is intended for adults and authorized representatives of churches, ministries, faith-based organizations, nonprofit organizations, and businesses. It is not directed to children under 13. By using the Website on behalf of an organization, you represent that you have authority to provide information and act for that organization. You may not use the Website if doing so is prohibited by applicable law.
3. Informational Website; No Automatic Client Relationship
Website content is provided for general informational, educational, marketing, and business-development purposes. Visiting the Website, completing The Discovery Form, scheduling a Clarity Call, sending an email, receiving general information, or discussing possible services does not create a client, consulting, fiduciary, agency, partnership, pastoral, or other professional relationship.
RK Media may accept or decline an inquiry or proposed engagement in its discretion, subject to applicable law. A paid engagement begins only after:
- RK Media accepts the engagement and the parties approve the scope.
- The Client Service Agreement and any required documents are signed.
- The required payment or deposit is received.
- Required information, permissions, and access are provided.
4. Website Information Is Not a Binding Service Offer
Descriptions of services, packages, pricing, schedules, availability, results, and deliverables on the Website are general information and may change. A final proposal and Client Service Agreement establish the actual scope, investment, schedule, payment terms, responsibilities, exclusions, and deliverables for a paid engagement.
RK Media is not required to provide a service merely because it appears on the Website, and Website information does not obligate RK Media to accept a project or honor an obvious error.
5. No Guarantee of Results
RK Media will provide approved services in good faith but does not guarantee follower growth, engagement, attendance, donations, volunteers, leads, sales, revenue, profits, search-engine rankings, advertising approvals, advertising performance, media coverage, viral content, ministry growth, organizational change, or any other particular result.
Results depend on factors outside RK Media's control, including client implementation, leadership decisions, audience response, market conditions, budget, consistency, timing, platform algorithms, third-party policies, technology, and economic conditions. Testimonials, examples, case studies, and past results are not guarantees of future performance.
6. Consulting, Educational, and Faith-Based Disclaimer
Website content and RK Media services are consulting and educational resources. Unless a separate written agreement expressly states otherwise and a properly qualified professional is involved, RK Media does not provide legal, tax, accounting, investment, financial, medical, mental-health, licensed counseling, or other licensed-professional advice.
Biblical, ministry-oriented, faith-centered, or prayerful content is provided for consulting, communication, teaching, or educational purposes. It does not replace the user's own pastoral, theological, denominational, board, leadership, legal, or professional review. Clients remain responsible for doctrinal, denominational, governance, safeguarding, and legal decisions.
7. User Responsibilities
You agree to:
- Provide accurate, current, and complete information.
- Use your true identity and accurately state your role and authority.
- Provide only information, files, media, logos, testimonials, music, sermons, writings, personal information, and other materials you have the right to provide.
- Obtain necessary permissions, consents, releases, licenses, board approvals, denominational approvals, and third-party authorizations.
- Protect passwords, account credentials, and secure links.
- Review Website information, proposals, deliverables, facts, names, dates, claims, links, disclosures, and final materials before relying on or publishing them.
- Comply with platform rules, advertising policies, privacy laws, intellectual-property laws, safeguarding duties, and other laws applicable to your activities.
8. Prohibited Uses
You may not use the Website to:
- Violate law, regulation, court order, contractual duty, intellectual-property right, privacy right, publicity right, or another person's rights.
- Commit fraud, impersonate another person, misrepresent authority, submit false information, or conceal the origin of content.
- Harass, threaten, abuse, defame, discriminate against, exploit, or harm another person.
- Upload malware, malicious code, unauthorized tracking, or material designed to interfere with systems or accounts.
- Attempt unauthorized access, security testing, password collection, scraping, data extraction, automated copying, or circumvention of technical controls.
- Copy, reverse engineer, reproduce, distribute, resell, publish, teach, train an AI system on, or commercially exploit RK Media's proprietary materials without written permission.
- Interfere with Website operation or use the Website in a way that creates unreasonable technical, legal, security, or reputational risk.
RK Media may restrict or terminate access, reject submissions, preserve records, and report suspected unlawful activity when reasonably necessary.
9. RK Media Intellectual Property
The Website and RK Media materials may include names, logos, trademarks, service marks, website copy, graphics, designs, reports, audits, frameworks, systems, methods, templates, forms, prompts, scorecards, checklists, training materials, workflows, videos, and other content owned by or licensed to RK Media.
RK Media retains all rights in its pre-existing and independently developed background materials, including MMTS™, reusable consulting systems, processes, methods, prompts, templates, assessments, scorecards, checklists, training materials, know-how, and branding systems.
RK Media grants you a limited, revocable, non-exclusive, non-transferable permission to view and use publicly available Website content for lawful personal or internal organizational evaluation. You may not reproduce, republish, distribute, sublicense, sell, commercially teach, create a competing system from, remove notices from, or otherwise exploit RK Media content without written permission.
10. User Submissions and Client Materials
You retain ownership of materials you lawfully own before submitting them. By submitting information or materials through the Website, you grant RK Media a limited permission to receive, copy, review, store, analyze, and use them as reasonably necessary to respond to the submission, evaluate a possible engagement, protect the Website, comply with law, and provide requested or approved services.
You represent that your submission does not violate law or another person's rights and that RK Media's permitted use will not require unauthorized payment, license, consent, or attribution. You remain responsible for client-provided information and materials.
Submitting confidential information through a public form does not create an attorney-client, clergy-penitent, health-provider, or other legally privileged relationship. Do not submit unnecessary sensitive information. A separate confidentiality agreement may apply when signed.
11. Photographs, Videos, Testimonials, and Portfolio Material
You may submit photographs, videos, audio, names, likenesses, testimonials, logos, sermons, teachings, and other media only when you have the necessary rights, permissions, releases, and authority.
RK Media will use a client's name, logo, testimonial, confidential information, case-study details, or non-public results for publicity only as permitted by the applicable signed agreement or separate written authorization. Results vary, and examples are not guarantees.
12. Privacy
RK Media's collection and use of personal information is described in the RK Media Privacy Policy. By using the Website, you acknowledge that information may be processed by RK Media and its service providers as described in that Policy and applicable notices.
The Privacy Policy will be available through a clearly labeled link in the Website footer and beside forms that collect personal information.
13. Third-Party Websites, Platforms, and Services
The Website is hosted through OpenAI's ChatGPT Sites service and currently links to Google Forms for The Discovery Form and Clarity Call information. RK Media uses Google Sheets, Drive, Docs, and Gmail for manual review and client-workflow support. Zoom or Google Meet may be used when identified in a meeting confirmation. No outside CRM, automated scheduler, online payment processor, RK Media analytics tool, or advertising pixel is connected at launch. RK Media does not control third-party policies, availability, security, data practices, or technical performance.
Links and recommendations do not constitute a guarantee or endorsement. Your use of a third-party service is governed by that provider's terms and policies. RK Media is not responsible for third-party outages, account restrictions, data loss, policy changes, or actions.
14. Pricing, Payments, Cancellations, Refunds, and Rescheduling
General Website pricing may change. The approved proposal, Client Service Agreement, invoice, and any written payment schedule control a paid engagement. The Website does not collect payment-card or bank information and does not process online payments at launch.
Unless a signed agreement states otherwise:
- Work begins only after the required agreement and payment are received.
- Payments may become non-refundable after applicable work, research, preparation, meetings, strategy development, reserved time, or other performance begins.
- Late, failed, disputed, or missed payments may result in paused work, postponed meetings, withheld deliverables, collection activity, or termination.
- Additional services, third-party costs, advertising spend, software, printing, travel, contractors, and other excluded expenses require separate approval and payment.
- Cancellation, refund, rescheduling, chargeback, and late-payment rules are governed by the applicable written agreement and invoice.

15. Website Availability, Accuracy, and Changes
RK Media may update, correct, restrict, suspend, or discontinue Website content or features at any time. The Website may contain errors, outdated information, interruptions, broken links, or technical issues.
RK Media does not promise that the Website will be uninterrupted, secure, error-free, complete, or suitable for every purpose. Users are responsible for confirming material information directly with RK Media before acting on it.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND PUBLIC CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." RK MEDIA DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RK MEDIA AND ITS OWNERS, PERSONNEL, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST OPPORTUNITY, BUSINESS INTERRUPTION, REPUTATIONAL HARM, OR THIRD-PARTY PLATFORM ACTIONS ARISING FROM WEBSITE USE.
FOR A CLAIM BASED ONLY ON PUBLIC WEBSITE USE AND NOT A PAID CLIENT ENGAGEMENT, RK MEDIA'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT, IF ANY, THE USER PAID DIRECTLY TO RK MEDIA FOR THE SPECIFIC WEBSITE FEATURE OR TRANSACTION GIVING RISE TO THE CLAIM.
A signed Client Service Agreement controls liability for a paid engagement. No limitation applies where liability cannot legally be excluded or limited.
18. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless RK Media and its owners, personnel, and contractors from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful Website use, your submissions, your violation of another person's rights, your misrepresentation of authority, or your breach of these Terms.
This section does not require indemnification for RK Media's own willful misconduct and does not expand obligations contained in a signed Client Service Agreement.
19. Suspension and Termination
RK Media may suspend, restrict, or terminate Website access; reject or remove submissions; or discontinue communications when reasonably necessary because of nonpayment, unlawful or deceptive activity, harassment, threats, security risk, misuse of intellectual property, repeated failure to cooperate, violation of these Terms, or conduct inconsistent with RK Media's ethical and professional standards.
20. Dispute Resolution and Governing Law
Before filing a lawsuit concerning Website use, the parties will attempt in good faith to resolve the dispute through direct written discussion. If unresolved, the parties will attempt non-binding mediation unless urgent injunctive relief is reasonably necessary or applicable law provides otherwise.
These Terms are intended to be governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any court proceeding is intended to be brought in a court of competent jurisdiction in Wyoming unless the parties agree otherwise in writing or applicable law requires another forum.
These Terms do not create mandatory arbitration. Arbitration will apply only if RK Media later adopts an attorney-approved clause or a separate signed agreement requires it.
21. Electronic Communications and Signatures
By contacting RK Media electronically, you consent to receive electronic communications related to your inquiry or relationship. Where permitted by law, electronic records, approvals, acknowledgments, and signatures may be treated as originals. Marketing communications remain subject to applicable opt-out rights.
22. Changes to These Terms
RK Media may update these Terms as services, Website features, technology, or law change. The revised Terms will display an updated effective or last-updated date. Continued Website use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
23. General Terms
23.1 Severability
If a provision is unenforceable, it will be modified only as necessary to make it enforceable, and the remaining provisions will remain in effect.
23.2 Waiver
Failure to enforce a provision once is not a waiver of future enforcement.
23.3 Assignment
You may not assign these Terms without RK Media's written consent. RK Media may assign them in connection with a merger, reorganization, financing, or transfer of business assets, subject to applicable law.
23.4 Relationship of the Parties
These Terms do not create employment, partnership, fiduciary, agency, franchise, joint-venture, pastoral, or other special relationship.
23.5 Entire Agreement for Website Use
These Terms and the Privacy Policy are the entire agreement concerning public Website use. Signed client agreements govern paid engagements and may supplement or replace these Terms for the specific subject they address.
23.6 Force Majeure
RK Media is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, illness, utility or internet failure, government action, war, civil unrest, labor disruption, cyber incidents, platform outages, or third-party service failures.
